The prolonged legal dispute between Nokia and Kenya’s Technoservice Limited has finally reached a conclusion. Let us take a trip down memory lane. Technoservice first filed a lawsuit in 2020, accusing Nokia of breaching a contract. This was after the Kenyan company lost its service centers and earnings to Microsoft. Despite initial attempts to settle the matter outside court, the case continued to gain momentum. It was reopened in 2022 at Kenya’s High Court, which referred it to the International Court of Arbitration (ICC).
Technoservice, however, claimed that the ICC was biased and that critical evidence was disregarded. The case stalled when the Kenyan firm was unable to pay the required arbitration fees. Despite this, Technoservice continued to pursue legal action, taking the matter to Kenya’s Court of Appeal.
In the latest development, the Court of Appeal dismissed Technoservice’s petition to block the referral to the ICC and its request for damages from Nokia. The court ruled that the case lacked sufficient grounds and urged both parties to resolve the issue internally, as per their partnership agreement.
Technoservice’s director accused Nokia of tax fraud and pointed out a conflict of interest, claiming that Nokia officials held influential positions at the ICC. Now, the question remains: will Technoservice finally close this chapter, or are we in for more legal battles?
